The lawsuit comes after Montana banned residents from accessing the tiktok social media platform
Montana has been the first US state to pass a sweeping ban on the social media platform.
Following the lodgment of the lawsuit, TikTok said the ban was not compatible with the constitutional right to free speech in the USA.
Authorities have expressed concerns that Tiktok data could be passed to the Chinese Communist Party in furtherance of the Chinese national interest.
“We believe our legal challenge will prevail based on an exceedingly strong set of precedents and facts.”
